The ownership and copyright applies to all documents and software provided by xxter bv. These documents and software cannot be made available to third parties without explicit permission of xxter bv.

xxter bv is not liable for damages of any kind caused by use of software of xxter bv.

xxter bv shall never be liable for damage in the form of software errors, loss or failure of anything provided by xxter bv.

The user indemnifies xxter bv for any claims of third parties.

All legal relationships in which xxter bv is a party, only Dutch law applies, even when the commitment has taken place partly or completely abroad or if a party concerned is domiciled there. The applicability of the Vienna Sales Convention is excluded.

The court in the place of establishment of xxter bv has exclusive jurisdiction to hear disputes, unless otherwise required by law.

Nevertheless, xxter bv has the right to submit the dispute to the applicable court according to the law.

Parties will only appeal to a court after they have made their best efforts to settle the dispute in mutual consultation.
